Summary

This position is located in the Department of Health and Human Services (DHHS), Office of the Secretary (OS), Immediate Office of the Secretary (IOS), Departmental Appeals Board (DAB). The DAB conducts impartial, independent review of disputed decisions under more than sixty (60) statutory provisions and provides legal support to the corps of Board Members, Administrative Law Judges (ALJs) and Administrative Appeals Judges (AAJs) on the Medicare Appeals Council.

Duties

ABOUT THE POSITION

The DAB, through direct delegation from the Secretary issues decisions under more than 60 statutory provisions governing Department of Health and Human Services (DHHS) programs. The Chair is responsible for exercising executive direction and leadership over the day-to-day activities and operations of the DAB, a staff division within the Office of the Secretary. In that capacity, the incumbent serves as a key advisor to DHHS leadership on adjudicative activities conducted by DAB Judges, adjudicative trends at the administrative appeals level and manages the Division's operations including strategic planning, assessment of objectives and results, and management of financial and human resources. Additional duties include evaluating the evolving needs of the organization and coordinating budget planning and execution including drafting and submitting written budget requests and justifications to the Office of Management and Budget (OMB) and the Congress.

As the Chair, the incumbent also:
Serves as a member of the Board and designates panels of three Board members to adjudicate appeals. Appraises the performance of the Executive Officer/Executive Director of Administration, Board members and senior level officials including the Deputy Board Chair, the Chief Administrative Appeals Judge, the Executive Director of the Medicare Operations Division, the Executive Director for Adjudication, and supervisory attorney advisors who serve as division directors of the DAB's three adjudicatory divisions, the Appellate Division, the Civil Remedies Division and the Medicare Operations Division.

  • This is a career position in the SES. Unless the selectee is already a member of the SES with career status or has successfully completed an SES Candidate Development Program certified by OPM. ECQ's will be required before appointment.
  • In order to be considered minimally qualified for this position, candidates must have had responsible professional experience at a senior level (equivalent to the GS-15 in either the General Schedule (GS) or a comparable pay plan).
  • Must possess J.D. or LL.B degree from schools accredited by the U.S. Department of Education (ED) or an accrediting institution recognized by the ED.
  • Active Membership or admission to the bar is required
  • Executive qualifications must be approved by OPM before appointment can be effectuated. If you are selected, you will be responsible for working with an HHS Executive Consultant, or Qualifications Review Board (QRB) Writer to develop ECQs.

Qualifications

Open to all groups of qualified individuals from the public. Current employees within the Federal Civil Service. Current Career SES and SES reinstatement eligibles. SESCDP graduates may also apply for noncompetitive consideration.

As a basic requirement, applicants must demonstrate progressively responsible leadership experience that is indicative of senior executive level management capability. To meet the minimum qualification requirements for this position, you must show in your resume that you possess the Fundamental Competencies, five Executive Core Qualifications (ECQs), and the Professional Technical Qualifications (PTQs) listed below. It is recommended that your resume emphasize levels or responsibility, scope and complexity of programs managed, and program accomplishments and results. Typically, experience of this nature will have been gained at or above the equivalent of the GS-15 grade level in the Federal service or its equivalent with state and local governments, the private sector, or non-governmental organizations. Failure to meet this basic qualification requirement and all executive and professional technical qualification factors will automatically exclude you from consideration.

Fundamental Competencies:

The following competencies are the foundation for success in each of the Executive Core Qualifications: Interpersonal Skills, Oral Communication, Integrity/Honesty, Written Communication, Continual Learning, and Public Service Motivation.

Executive Core Qualifications (ECQs):

1. Leading Change: The ability to bring about strategic change, both within and outside the organization, to meet organizational goals. Inherent to this ECQ is the ability to establish an organizational vision and to implement it in a continuously changing environment.

2. Leading People: The ability to lead people toward meeting the organization's vision, mission, and goals. Inherent to this ECQ is the ability to provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports constructive resolution of conflicts.

3. Results Driven: The ability to meet organizational goals and customer expectations. Inherent to this ECQ is the ability to make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks.

4. Business Acumen: The ability to manage human, financial, and information resources strategically.

5. Building Coalitions: The ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.

Professional Technical Qualifications (PTQ's):

This position also requires that you possess PTQ's that represent knowledge, skills, and abilities essential for success in this role. The following PTQ's must be evident in your resume.
  1. Describe experience in examining or applying complex legal principles in which precedents were conflicting or non-existent in order to make determinations and conclusions that guided the organization in resolving subsequent, similar problems; or resulted in the development of positions on legal issues that were precedent setting, had government-wide impact and were binding on other Federal agencies.
  2. Experience in developing and implementing organization-wide operations and processes for advising high level organizational officials and external stakeholders on complex and difficult legal questions or factual issues.
  3. Experience in formulating, developing, implementing, and revising policies, strategies, and processes in order to provide high-quality adjudication services and maintain efficient and responsive business practices including demonstrated ability to identify, understand, and navigate issues that arise during the development and implementation of regulations and policies.
  4. Seven years of experience as a licensed attorney preparing for, participating in and/or reviewing formal hearings or trials involving litigation and/or administrative law at the Federal, State, or local level.

IF SELECTED, you will be required to complete an ECQ package by drafting narratives for each of the ECQs and PTQs and be certified by an OPM (QRB) in order to be appointed to this position. If you are currently serving in a career SES appointment, are eligible for reinstatement into the SES, or have successfully completed an SES Candidate Development Program approved by the Office of Personnel Management (OPM), you WILL NOT need to draft the ECQs.
